Lexicum Terms & Conditions

1. General

The Lexicum website ("Website") and related services (together with the Website, the "Service") are operated by Lexicum Ltd. ("Lexicum," "us," or "we"). Access and use of the Service is subject to the following Terms and Conditions of Service ("Terms and Conditions"). By accessing or using any part of the Service, be it from a web browser, via the synchronization system built into various Lexicum clients, or some other way, the User ("you" or "your") represents that they have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. We reserve the right to modify, elaborate, remove or add to some or all of the conditions preserved here within these Terms and Conditions, at our sole discretion and without further notice. All such changes will be posted directly to this page with the date of the most recent modification to these Terms and Conditions at the top of the page. Your continued use of the Site or of the Service after any such changes constitutes your acceptance of these new Terms and Conditions and it is your sole responsibility to keep up to date with any such changes.

2. Registration Obligations

In connection with registering for and using the Service, you agree (i) to provide accurate, current and complete information about you and/or your organization as requested by Lexicum; (ii) to maintain the confidentiality of your password and other information related to the security of your account; (iii) to maintain and promptly update any registration information you provide to Lexicum, to keep such information accurate, current and complete; and (iv) to be fully responsible for all use of your account and for any actions that take place through your account.

3. Proprietary rights

In consenting to these Terms and Conditions, you agree that you will, neither wholly nor in part, copy, modify, rent, lease, loan, sell, re-sell, distribute or create derivative works based on the Service or the Software. You agree not to modify the Software in any manner or form. You agree not to obtain unauthorized access to the Service, for yourself or on behalf of a third party. You agree not to access the Service by any means other than through the interface that is provided by Lexicum for use in accessing the Service. You agree to make no attempt to reverse-engineer or otherwise discover the source-code of the Software.

If any provision of this agreement is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from this agreement and rendered ineffective as far as possible without modifying the remaining provisions of this agreement, and shall not in any way affect any other circumstances of or the validity or enforcement of this agreement.

4. Privacy

4.1. Information Lexicum Collects

Lexicum collects two types of information: (i) personal information, such as your name and email address, you submit via the Service and (ii) information regarding your use of the Service collected by us as you interact with the Service in order to improve its quality. Unless required by law, we will not share this information with anybody.

4.2. Use of Information Obtained by Lexicum

We understand that the data you send to Lexicum is confidential and we treat it as such. We will never share the data you send us with anyone unless required by law. Access will be restricted to certain Lexicum staff in order to provide support and develop the service. We may use your contact information to send you notifications regarding new services offered by Lexicum and its partners that we think you may find valuable. Lexicum may also send you service-related announcements from time to time through the general operation of the Service. We do reserve the right to publish aggregated studies, but stripped of any personal information, and to share it with research institutions, in order to advance cognitive science, or to help promote Lexicum. This data may be used by Lexicum and shared with third parties in any manner.

4.3. Cookies

Cookies are small amounts of data that we send to your browser that are stored on your computer's hard drive. We use cookies to access information when you sign in, to store your preferences, to keep you logged in, and to store a limited amount of behavioral data. You can configure your browser to accept or reject these cookies.

4.4. Links

The Service may contain links to other websites. We are of not responsible for the privacy practices of other websites.

5. Limitation of Liability

You agree to defend, indemnify and hold harmless Lexicum and its directors, officers, employees, contractors, agents, suppliers, licensors, successors and assigns, from and against any and all losses, claims, causes of action, obligations, liabilities and damages whatsoever, including attorneys' fees, arising out of or relating to your access or use of the Service, any false representation made to us (as part of these Terms and Conditions or otherwise), your breach of any of these Terms and Conditions,or any claim that any translation we provide to you is inaccurate, inappropriate or defective in any way whatsoever.

Included among the reasons for damages for which you expressly agree that we are not liable, are (i) the inability to access or use the Service for whatever reason; (ii) inaccurate results; (iii) loss or corruption of data or data being rendered inaccurate; (iv) the cost of recovering any data; (v) the cost of procuring a substitute of any kind; (vi) the negative consequences of having to use alternative products; (vii) any other matter relating directly or indirectly to the Site or Service.

Lexicum's liability to you or any third party claiming through you for any cause whatsoever, and regardless of the form of the action, is limited to the amount paid, if any, by you to Lexicum for the Service in the 6 months prior to the initial action giving rise to liability. This is an aggregate limit. The existence of more than one claim hereunder will not increase this limit. Note that in no case will Lexicum's total liability exceed EUR 1000. In the case where no fees have been paid by you to Lexicum, then you shall be limited to injunctive relief only, and shall not be entitled to any damages of any kind.

6. Disclaimer of Warranty

You expressly understand, warrant and agree that: Lexicum and its officers, employees, agents, partners and licensors make no warranty of any kind that (i) the Service will meet your requirements or expectations; (ii) that the Service will be continuous, accurate, available, complete or secure; (iii) that the results following from use of the Service will be desirable.

Your Use of the Service, which is provided on an "AS-IS" and "as available" basis, is your sole responsibility, and is at your sole risk. Lexicum and its officers, employees, agents, partners and licensors expressly disclaim all warranty of any kind.

Any material downloaded through the Site or the Service is so downloaded at your own sole risk. In addition, the medical consequences of using Lexicum are your sole responsibility.

7. Governing Law and Arbitration

These Terms and Conditions, its subject matter and Lexicum's and your respective rights under these Terms and Conditions shall be governed by and construed under English law. Any dispute arising between you and Lexicum will be resolved by binding arbitration and shall be referred for resolution to the Court of Arbitration at the European Judicial Chamber, Sofia, Bulgaria, in compliance with its Expedient Procedure in the Rules for Litigations, based on arbitration agreements.

8. Language

This agreement was originally written in English. To the extent any translated version of this agreement conflicts with the English version, the English version controls.

9. Miscellaneous

These Terms and Conditions constitute the entire agreement between Lexicum and you concerning the subject matter hereof. In the event that any of the Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect. A waiver by Lexicum or you of any provision of these Terms and Conditions or any breach thereof, in any one instance, will not waive such term or condition or any subsequent breach thereof. Lexicum may assign its rights or obligations under these Terms and Conditions without condition. These Terms and Conditions will be binding upon and will inure to the benefit of Lexicum and you, and Lexicum's and your respective successors and permitted assigns.

Repeating a word - either verbally or in writing - is common; it's also boring and ineffective - transition to long term memory requires spaced repetition. The latter can be achieved with flashcards - but these are time-consuming and unwieldy. Personal vocabulary books have been encouraged - these help keep track of one's growing personal vocabulary but they can only present the words in the order they were added.

Recently, the rise of electronic flashcards apps for smartphones has been a breath of fresh air, allowing learners to pass time with a productive activity. These, however, have not tapped into the full potential technology offers - they just feed you words they think you should be learning, asking you to repeat them until you memorise them mechanically, never learning how to use them in a sentence.
